Group Release and Waiver of Liability, Assumption of Risk and Indemnity Agreement (the "Agreement")

Upon signing this agreement on behalf of your group, your group is waiving legal rights and abandoning its right to sue the Corporation of the Town of Saugeen Shores (hereinafter referred to as the "Town of Saugeen Shores") for any damages, howsoever caused.

Please read this document carefully.

In consideration for the undersigned group’s right to use or right to continue using the facilities of the Town of Saugeen Shores, I

Acknowledge, appreciate and agree that:

1. The group assumes full responsibility for its members' participation in any activities or use of the facilities of the Town of Saugeen Shores and agrees that the group's use of the facilties of the Town of Saugeen Shores is entirely voluntary.
2. The group hereby freely assumes all such risks, howsoever caused, including the possibility of its members' exposure to COVID-19-related or other communicable diseases, personal injury, property damage, or resultant loss, even if arising out of the negligences of the Town of Saugeen Shores.
3. Use of the facilities of the Town of Saugeen Shores carries with it risk of exposure to communicable diseases and such risk exists in any public place where people are present. The group agrees to take any and all up-to-date safety precautions promoted in an official capacity by various Canadian health authorities, including Ontario Health, Health Canada, etc., while using the Town of Saugeen Shores facilities, particularly but not limited to those involving handwashing, social distancing, the wearing of masks etc.
4. The group hereby agrees to waive any and all claims that it has or may have in the future against the Town of Sagueen Shores involving COVID-19 related or other communicable diseases. The group releases the Town of Saugeen Shores from any and all liability for any loss, damage, expense or injury, including death, that it or its members may suffer, as a result of its usage of the Town of Saugeen Shores' facilities, howsoever caused; such causes may include, but are not limited to: any duty of care created by the Occupiers' Liability Act, RSO 1990, c02, any other statutory duty of care, any negligence of the Town of Saugeen Shores, or breach of contract.
5. The group also agrees that if, despite this waiver, the group, its members, or anyone on the group's behalf should make claims against the Town of Saugeen Shores, the group or its directors, officers, or other representatives agree to indemnify the Town of Saugeen Shores from any litigation expenses, loss, liability, legal fees, damage, or costs which may be incurred as of the result of such claims.
6. The group agrees to maintain insurance with the Town of Saugeen Shores and further agrees that the group will carry, at all times from the date of signing this document onward, insurance which covers all risks, including but not limited to coverage for personal injury liability, contractual liability, and employers liability which insures the group, and the Town of Saugeen Shores as an Additional Insured, for COVID-19 and other communicable disease-related liability.
7. This release shall be binding on the group's legal representatives or other representatives.
8. The undersignded agrees that in signing this waiver, they or the group are not relying on any oral, written or implied representations or statements made by the Town of Saugeen Shores with respect to the interpretation of this waiver or the safety of the Town of Saugeen Shores facilities.
9. The undersigned has read this waiver prior to signing it on behalf of the group, realizes that this is a legal binding document, has had the opportunity to fully review its terms, and is aware that by signing on behalf of the group, the group waives legal rights, including but not limited to those listed above.
